Financial Guarantee for Home Care Service Organisations

French decree n°2024-1161 of 4 December 2024 makes a financial guarantee mandatory for SAP organisations using the URSSAF Avance Immédiate scheme. Lesto distributes this product through one of the rare insurers offering it on the market.

As soon as your clients pay all or part of your services through Avance Immédiate, the financial-guarantee obligation applies.

You collect advance payments

With advance payments, the obligation applies from the first euro collected through the scheme, whatever your revenue.

You exceed €200,000 (VAT incl.) in revenue

Without advance payments (100% URSSAF), the obligation starts at €200,000 (VAT incl.) in annual revenue.

What is the financial guarantee for SAP organisations?
It is a guarantee required by French decree n°2024-1161 of 4 December 2024 for home-care service (SAP) organisations that use the URSSAF Avance Immédiate scheme. It secures the sums advanced by URSSAF on behalf of your clients. An insurer stands as guarantor in your place, in exchange for an annual premium.
Who is subject to the obligation?
Any SAP organisation collecting payments through Avance Immédiate: from the first euro if it takes advance payments, and from €200,000 (VAT incl.) in annual revenue if it works without advance payments (100% URSSAF).
How much guarantee do I need?
The amount depends on your revenue (VAT incl.): €15,000 under €500,000, €20,000 up to €1M, €50,000 up to €5M, €150,000 up to €20M, then €300,000, €600,000 and €1,200,000 for the upper brackets (see the table above).
How quickly can I get my certificate?
The subscription journey is fully online. Once the file is complete, the compliant certificate is issued within 24 hours.
Does the financial guarantee replace my Professional Liability insurance?
No. The financial guarantee covers a regulatory obligation tied to Avance Immédiate; it does not cover damage caused to your clients or third parties in the course of your activity, which falls under Professional Liability.
